Abstract

Mr. Sgt. Freddy Gustavo Velasco Ortega after 25 years of service in the Armed Forces, intends to ascend to the rank of senior officer, for which according to current institutional regulations, he has to comply with a promotion course called the Command and Leadership course. First sergeant Velasco postulates for the course in question, but unfortunately after its evaluation, the commission resolves to declare it NOT suitable for the course, due to the fact of having children outside the marriage, which makes it impossible for the ascent. The resolution of the Qualifying Commission for admission to the Command and Leadership course is an Unconstitutional and Discriminatory resolution, which violates fundamental Rights and Principles.
