| Résumé: | The purpose of this paper is to analyze the figure of the Extracontractual State Responsibility in Ecuador, its historical background, regulatory development, elements, the applicable procedures for the claim and the scope of application that the recent Organic Administrative Code has established in comparison with the Statute of the Legal Regime of the Executive Function, regulations already repealed, allowing thus to conclude whether or not the regulations applicable to Extracontractual Responsibility that is in the current norm are sufficient for the citizen to be able to claim a fair compensation. |
| Description: | El presente trabajo tiene por finalidad analizar la figura de la Responsabilidad Extracontractual del Estado en Ecuador, sus antecedentes históricos, desarrollo normativo, elementos, los procedimientos aplicables para el reclamo y el ámbito de aplicación que el reciente Código Orgánico Administrativo ha instaurado en comparación con el Estatuto del Régimen Jurídico de la Función Ejecutiva, normativa ya derogada, permitiendo así concluir si es o no suficiente la normativa aplicable a la Responsabilidad Extracontractual que se encuentra en la actual norma para que el ciudadano pueda reclamar una justa indemnización. |
