Abstract: | Human rights are based on natural law which was recognized on Constitutions after decades of conflicts. It emerged after World War II, because countries seen that current mechanisms wasn't enough to protect they citizens, it was necessary created a International Organizations that assume the responsibility of keep relations between States and take care about citizens human rights inside of signature countries. Ecuador includes on Constitution a chapter about the application of human rights instruments, conventions, it establishes that they are directly apply when they are more favorable than Constitution, in that way, there lay down that their accomplishment are mandatory. In other hand, non-compliance with the measures provided in the sentence has been ineffective due to the lack of suitable mechanisms despite having legal enforceability by Constitution Ecuador has decreed to Ministerio de Justicia Derechos Humanos y Culto the coordination of compliance with human rights, treaties, conventions, instruments. In addition, the Constitution includes a jurisdictional guarantee called Action for failure comply , which is the last instance in which victims can claim when sentences and reports haven't been comply |
Description: | Los derechos humanos tienen origen en el derecho natural de los hombres, sin duda alguna, su reconocimiento dentro de ordenamientos jurídicos fue una lucha constante. Inclusive estos nacen después de la II Guerra Mundial, una época devastadora, en la que varios Estados sumergidos en la necesidad, se obligan a proteger los derechos humanos dentro de sus países y en instancias internacionales. Ecuador es uno de los países que más avances constitucionales posee en materia de derechos, inclusive ha elevado a instrumentos y tratados de derechos humanos a rango constitucional. No obstante, el cumplimento de informes y sentencias ha sido ineficaz debido a la falta de mecanismos idóneos. Se ha decretado al Ministerio de Justicia Derechos Humanos y Culto la coordinación del cumplimiento de estos Instrumentos internacionales, e inclusive en la Constitución incluye una garantía jurisdiccional llamada Acción por incumplimiento, la que sirve de última instancia cuando se ha dado incumplimiento de sentencias e informes. |
