| Abstract: | The present work is a study on the rights and guarantees of workers in private companies in Ecuador that face unfair dismissal. Unfair dismissal is a legal figure that persists in the legislation but it violates the emotional, mental and economic stability of the worker. In the first place, the conceptual framework will be studied, differentiating the unfair dismissal from other key concepts in labour law. Besides, the legal framework will be analyzed with the most important aspects of unfair dismissal. A comparison of the Ecuadorian legislation with the legislation of other countries of the region will be made in regarding this legal figure; and finally, a legal proposal will be formulated as a solution to the problematic, reaffirming the labor stability of the worker. |
| Description: | El presente trabajo es un estudio sobre los derechos y garantías del trabajador en las empresas privadas en Ecuador ante el despido intempestivo. El despido intempestivo es una figura jurídica que persiste en la legislación pero que atenta contra la estabilidad emocional, mental y económica del trabajador. En primer lugar, se estudiará el marco conceptual, diferenciando el despido intempestivo de otros conceptos claves en el derecho laboral. Asimismo, se analizará el marco legal con los aspectos más importantes del despido intempestivo. Se realizará una comparación de la legislación ecuatoriana con la legislación de otros países de la región en cuanto a dicha figura jurídica; y finalmente, se formulará una propuesta legal que incluya una solución a la problemática reafirmando la estabilidad laboral del trabajador. |
