| Résumé: | Lawyers see with great concern how the num. 6 of art. 333 of the General Organic Code of Processes (COGEP) discriminates against us by denying us the constitutional right to appeal the sentences that are pronounced within the trials in which the controversies between the lawyer and client for the payment of professional fees are aired, highlighting this legal provision that appeals cannot be lodged against these sentences, not even in fact, which prevents us from reviewing our sentence by an appeal judge in the event that it is unfavorable to our interests. In this sense, the general objective of the present work is to analyze and establish how the num. 6 of art. 333 of the COGEP violates the constitutional principle of appealing the ruling or resolution in all procedures in which it is decided on our rights guaranteed in lit. m) of no. 7 of art. 76 of the Constitution. The methodology used has a qualitative approach, since it plans to study the aforementioned constitutional principle, establishing its scope, its recognition as a principle and guarantee in our Constitution and in international instruments, and how the restriction of this right is unconstitutional and discriminatory within summary trials for collection of professional fees. The results of the case study show that the num. 6 of art. 333 of the COGEP is discriminatory and violates the rights to due process and defense, so it is concluded that the unconstitutionality of this article should be sued. |
| Description: | Los abogados vemos con mucha preocupación como el num. 6 del art. 333 del Código Orgánico General de Procesos (COGEP) nos discrimina al negarnos el derecho constitucional de recurrir las sentencias que se pronuncien dentro de los juicios en que se ventilen las controversias entre el abogado y cliente por el pago de honorarios profesionales, remarcando esta disposición legal que contra estas sentencias no podrán interponerse los recursos de apelación ni de hecho, con lo cual se nos impide que un juez de alzada revise nuestra sentencia en el caso de que nos sea desfavorable para nuestros intereses. En ese sentido, el objetivo general del presente trabajo es analizar y establecer cómo el num. 6 del art. 333 del COGEP vulnera el principio constitucional de recurrir el fallo o resolución en todos los procedimientos en los que se decida sobre nuestros derechos garantizado en el lit.m) del num. 7 del art. 76 de la Constitución. La metodología empleada tiene un enfoque cualitativo, pues tiene previsto estudiar el referido principio constitucional estableciendo su alcance, su reconocimiento como principio y garantía en nuestra Constitución y en instrumentos internacionales y cómo resulta inconstitucional y discriminatoria la restricción de este derecho dentro de los juicios sumarios por cobro de honorarios profesionales. Los resultados del estudio del caso demuestran que el num. 6 del art. 333 del COGEP es discriminatorio y viola los derechos al debido proceso y a la defensa, por lo que se concluye que debe demandarse la inconstitucionalidad de este artículo. |
