Abstract

Freedom of speach is a fundamental and inalienable right that establishes that all individuals can express their ideas and opinions in the way they believe is most convenient. Together with the right to resistance, it causes so-called demonstrations to exist, which seeks to generate es that a group of individuals can be heard in the right place and at the right time, but there is a problem and that is that the moment these two rights exceed their limits and causes damage, destruction, acts of vandalism to public or private property, it is notorious that it becomes a problem for the entire society. Current laws do not establish a balance point where freedom of expression, the right to resistance and respect for public-private property can be respected. The purpose reached in this work is that it is necessary to establish that point of balance so that there is no transgression of both the fundamental rights that are stipulated in the constitution and the protection that has been granted to properties.
