| Résumé: | The objective of this degree work is to carry out an in-depth analysis of our legal systemin order to identify the shortcomings that our legislation has regarding the lack of a regulatoryframework that regulates Assisted Reproduction techniques. Therefore, the rights that have been violated as a result of the problem raised and the effects that regulating it would entail given our current legal system will also be identified. For this purpose, Ecuadorian jurisprudence will be analyzed with respect to the subjectof assisted reproduction, doctrine, opinions of international instances that have issued criteriain this regard and in this way venture to propose a normative proposal that repairs the shortcomings of our legal system. |
| Description: | El presente trabajo de titulación tiene como objetivo llevar a cabo un análisis profundo denuestro ordenamiento jurídico con el fin de identificar las falencias que nuestra legislación tiene respecto a la falta de un marco normativo que regule las técnicas de Reproducción Asistida. Porlo tanto, también se identificará los derechos que han sido vulnerados a raíz de la problemática planteada y los efectos que conllevaría regularlo dado nuestro actual sistema jurídico. Para tal propósito se analizará jurisprudencia ecuatoriana con respecto a la temática de reproducción asistida, doctrina, dictámenes de instancias internacionales que han emitidocriterios al respecto y de esta forma aventurarme a plantear una propuesta normativa que reparelas falencias de nuestro ordenamiento jurídico. |
