| Résumé: | In the present investigative work, it is intended to analyze the limitation of access to adoption for same-sex couples and its consequences such as the violation of the rights of minors couples who wish to access this adoption, this after the approval of same-sex marriage. That is why it is necessary to know certain legal figures such as adoption and its legal historical background in order to know the way in which they have been modified according to the progress of society, such as the legal figure of the family, given the currently not only the “traditional” family is recognized. We will study important sentences where the same rights are recognized to a same-sex couple compared to a different sex and the ways that our State would have in order to recognize this type of adoption to protect and enforce the State of rights and justice, thus protecting vulnerable groups such as in this case minors waiting for a family. |
| Description: | En el presente trabajo investigativo se pretende analizar la limitación del acceso a la adopción para parejas del mismo sexo y sus consecuencias como la vulneración de derechos de los menores y las parejas que desean acceder a esta adopción, esto tras la aprobación del matrimonio igualitario. Por eso es necesario conocer ciertas figuras jurídicas como la adopción y sus antecedentes históricos jurídicos con el fin de saber la manera en que se han ido modificando de acuerdo con el progreso de la sociedad tal como la figura jurídica de la familia dado que actualmente no solo se reconoce a la familia “tradicional”. Estudiaremos sentencias importantes donde se les reconoce los mismos derechos a una pareja del mismo sexo frente a una de distinto sexo y las vías que tendría nuestro Estado a fin de reconocer este tipo de adopción para proteger y hacer valer el Estado de derechos y justicia, protegiendo asi a grupos vulnerables como en este caso a los menores en espera de una familia |
