| Abstract: | Within the work carried out, the explanation, analysis and, above all, criticism are addressed regarding the process by which that limitation to the domain called "family patrimony" was constituted in an erroneous way, specifically, in the contractual processes between natural persons and legal state laws within the Ecuadorian legislation, and will delve into the affectation that it caused, specifically to free real estate traffic and, consequently, to the principle of contractual good faith. Additionally, the explanation of the correct constitution process is provided and a solution is proposed through the analysis of the wrongly applied norms for their correct validity and, so that there is legal effectiveness in terms of the actions of the authority in charge of the creation of it. |
| Description: | Dentro del trabajo realizado se aborda la explicación, análisis y por sobre todo la crítica en cuanto al proceso por el cual se constituía de forma errónea aquella limitación al dominio llamada “patrimonio familiar”, específicamente, en los procesos contractuales entre las personas naturales y las jurídicas estatales dentro de la legislación ecuatoriana, y se ahondará en la afectación que acarreó, concretamente al libre tráfico inmobiliario y, consecuentemente, al principio de buena fe contractual. Adicionalmente, se brinda la explicación del proceso correcto de constitución y, se propone una solución a través del análisis de las normas aplicadas erróneamente para la correcta validez de las mismas y, para que exista una eficacia jurídica en cuanto al actuar de la autoridad encargada de la creación del mismo. |
