La seguridad jurídica en los actos y contratos notariales con implementación de medios tecnológicos.

Abstract

The General Objective of this research is to analyze legal certainty in notarial acts and contracts with the implementation of technological means, especially in those situations in which for different reasons of fortuitous event or force majeure, such as the case of the Covid- 19 the parties could not go to the physical headquarters of the notary. As antecedents of the investigation, mention can be made of the one carried out by Gunter González, which is called Registry and Notarial Law, and the one by Federico Arcos called Legal certainty, since both are relevant to the study variables of the present investigation. The methodological approach was of a qualitative nature for the analysis of the legal case, and within this modality the non-interactive one was used, applying the concept analysis design, the inductivedeductive and the synthetic analytical method was used that allowed the achievement of the Research objectives. As a result of this, it was possible to demonstrate that safer means of implanting in the notarial system are currently required for the purposes that in situations where the physical presence of the parties to perform the notarial act is not possible, but in such a way that there is no doubt about the identity of the people. Finally, it was concluded that, in order to provide greater legal certainty, biometric identification should be made mandatory in the notarial service, since it is a very viable alternative, which has given positive experiences in neighboring countries.
