| Abstract: | This analysis reveals the problem in a social area for many invisible but necessary in times of global commotion, humanitarian and health crisis; that is, faith. It examines the constitutionality of restrictions on freedom of religion, faith and assembly in cases of states of emergency in times of pandemic (Covid-19) and the outcome of those restrictions. It analyzes the use of the decrees of states of exception in the rights of religious freedom and their public manifestation through the different rites and the right of minority religious groups, such as the evangelical Baptist community. The present research work is carried out through the documentary analysis of the documents issued by the first state of exception being presidential decree 1017 and the Constitutional Court Case No. 1-20-EE/20, which complies with the type of descriptive research under the qualitative approach. |
| Description: | El presente análisis revela la problemática en un área social para muchos invisible, pero necesaria en tiempos de conmoción mundial, crisis humanitaria y de salud; es decir, la fe. Se examina la constitucionalidad de las restricciones a la libertad de culto, fe y reunión en los casos de estados de excepción en tiempos de pandemia (Covid-19) y el resultado de aquellas restricciones. Se analiza el uso del decreto de estado de excepción 1017 y el dictamen de la Corte Constitucional en el Caso No. 1-20-EE/20, en los derechos de libertad religiosa y su manifestación pública por medio de los diferentes ritos y el derecho que tienen los grupos religiosos minoritarios, como la comunidad evangélica Bautista. El presente Examen Complexivo se realiza a través del análisis documental con relación al primer estado de excepción, siendo estos el estudio de caso teórico al decreto presidencial 1017 y el dictamen de la Corte Constitucional en el Caso No. 1-20-EE/20, el cual cumple con el tipo de investigación descriptiva bajo el enfoque cualitativo. |
