Abstract

The application of fortuitous events or force majeure, as an extinguishing effect to the contractual obligations between employers and workers, is duly regulated in our Labor Code. COVID-19 has accelerated the application of this regulatory budget, having as its main effect the termination of the employment relationship which, since it is terminated in a legal and due manner, does not merit any compensation payment in favor of the worker. Our legislation has not regressed in the applicability of this legal institution, on the contrary, it protected, promoted and regulated it, in such a way that it pointed out the necessary factual requirements by which the employer could allege said cause in his favor.
