Análisis de la figura jurídica de expropiación.

Abstract

In the present work we will analyze the legal figure of expropriation, as the exclusive power of the Ecuadorian state and from the point of view of the Municipal Decentralized Autonomous Governments, its historical origin and legal nature, as well as the necessary requirements for it to be configured , its effects and the applicable legal regime in our legislation. We will analyze the expropriation process established in the legal bodies in force, such as the Organizing Code for Territorial Planning, Autonomy and Decentralization, the Land Planning Law, the Public Procurement System Law, among others. In the same way we will analyze if the owners of it well expropriated are fairly compensated and if a value is paid according to the price of their property. We will study what are the fair and applicable ways to force or avoid expropriation, as well as the possible solution to request before the competent authority an increase in the price to be received by the expropriating authority.
