| Abstract: | In the present investigation a study is carried out regarding the process for the correct imposition of environmental sanctions and the effects thereof, through the application of the principles governing administrative sanctioning procedures. After this analysis it is possible to emphasize the violation of principles such as proportionality and legal certainty, so through a legal analysis we will be able to observe the repercussions of sanctions that are fixed in a discretionary way against the principles that are guaranteed by the Constitution |
| Description: | En la presente investigación se realiza un estudio respecto al proceso para la correcta imposición de las sanciones ambientales y los efectos de las mismas, a través de la aplicación de los principios que rigen los procedimientos administrativos sancionadores. Tras este análisis se puede enfatizar en la violación de principios como el de proporcionalidad y seguridad jurídica, por lo que a través de un análisis jurídico podremos observar las repercusiones que tienen las sanciones que se fijan de manera discrecional frente a los principios que son garantizados por la Constitución. |
