| dc.description | Esta tesis se ubica dentro del derecho procesal, tiene como objeto analizar a la institución del abandono, su naturaleza, la forma como ha sido concebido en el Código Orgánico General de Procesos COGEP, y como su inadecuada regulación conlleva a una necesidad de reforma, la cual aún es un proyecto, fue necesario estudiar el tema con el fin de conocer en qué consiste y si es que es beneficioso para las partes, el trabajo inicia conceptualizando al abandono como una forma extraordinaria de concluir un proceso y la forma en la que está regulada actualmente en el Código Orgánico General de Procesos, por otra parte, se tomó en consideración a la propuesta reforma ya que implica un análisis de los cambios en los que podría verse afectado el COGEP, en el caso de entrar en vigencia, y de qué manera dichos cambios podrían tener una afectación a la tutela judicial efectiva de los implicados en los procesos. | en_US |
| dc.description.abstract | This thesis lies within procedural law, aims to analyze the institution of abandonment, its origin, the way it has been conceived in the Code Organic General of processes COGEP, and as its inadequate regulation leads to a need for reform, which is still a project, but I saw a need to study the matter in order to know what it is and if it is beneficial to the parties, this document starts conceptualizing the abandonment as an extraordinary form of concluding a process and the way in which is regulated currently in the General code of processes, on the other hand, took into consideration proposed reform since it involves an analysis of the changes that could be affected COGEP, in the case of entering in force, and how those changes might have an affectation to effective judicial protection of those involved in the process. | en_US |
