El silencio administrativo en el Código Orgánico Administrativo.

Abstract

The right must evolve as society evolves. Consequently, in the field of administrative law, legislators have seen the need for the creation of an Administrative Organic Code, which has been issued for the first time in Ecuador. This becomes a defense for the citizen before the procedures that are presented before the public administration and in which the inactivity of the public official is punished. The present work will develop a brief analysis on the new aspects that this new Code brings with respect to the juridical administrative silence figure, and in turn, to contrast with the antecedent norms to this one. Likewise, we will analyze the novelties that the code brings as the improvements that it brings in terms of the procedure of execution of the same, we will even expose certain observations that we believe important according to our analysis made to the norms corresponding to the administrative silence.
