| dc.description | En el presente trabajo de titulación tiene como objetivo hacer un análisis acerca de la naturaleza jurídica de las medidas cautelares constitucionales autónomas. Y para ello es preciso iniciar el análisis abordando las medidas cautelares en general sus principales antecedentes, para luego ir en concreto al estudio de las medidas cautelares en el Derecho Constitucional y consecuentemente analizar las medidas cautelares en la legislación constitucional ecuatoriana con su respectiva jurisprudencia. Finalmente analizar someramente las tendencias en el régimen cautelar como son las medidas Autosatisfactivas de la doctrina Argentina, en la que posterior a su desarrollo veremos si sus características se ajustan o no en las medidas cautelares constitucionales autónomas. | en_US |
| dc.description.abstract | This Academic essay has the objetive of analizaing the legal nature of the autonomous constitutional precautionary measure. In order to do so, it is necessary to explain precautionary measures, then explain the main antecedents of these measures, and in particular, to study the precautionary measures in Constitutional Law and consequently to analyze the precautionary measures in Ecuadorian constitutional legislation based on Ecuatorian jurisprudence. Finally, this essay will try to analyze the tendency of the precautionary regime, such as the Autosuccessful measures of the Argentine doctrine, which we will analyze and determine if its characteristics fit or not with the autonomous constitutional precautionary measures. | en_US |
