Eficacia de las medidas de protección en los delitos de violencia de género.

Abstract

The general objective of this research was to establish the need to strengthen inter-institutional coordination, optimize the training of justice operators, and consolidate follow-up mechanisms after their adoption, with the aim of ensuring comprehensive and effective protection within the Ecuadorian context. Specific objectives included conducting a historical doctrinal analysis of the existence and evolution of domestic violence offenses involving psychological violence, to establish the main aspects and effects of the lack of control over the imposition of detention or socio-educational measures, and to propose the components of the control program to be implemented with the due authorization of the group of experts of the Judicial Council to ensure the true effectiveness and impact of the protection measures. The research was developed under a qualitative approach, with a legal-dogmatic analytical method, complemented by the analysis of national legislation, international regulations and relevant jurisprudence. The results show that it is pertinent to apply a post-post control program that is implemented and managed through inter-institutional agreements with different members of the judiciary and civil society through foundations.
