Abstract

In this essay we talk about the right to identity which is fundamental in human life, since it allows each person to be recognized as unique, unrepeatable and distinct within society, because this right is composed of two dimensions: the static, which remains unchanged over time, and the dynamic, which is subject to changes as the individual develops socially in the static dimension covers attributes such as name, affiliation, sex, nationality, among others, which allow each individual to differentiate themselves externally from the dynamic dimension includes aspects such as beliefs, values, culture, education and profession, which reflect the social projection of the individual and also contribute to their personal identity, in this sense the right to identity of children born through assisted reproduction seeks to ensure that each person is recognized in their entirety, respecting both their static and dynamic attributes, without alterations or distortions. Through judgment No. 184-18-SEP- CC of the Constitutional Court of Ecuador, the importance of protecting this right is emphasized, ensuring that the individual can be faithfully represented in his or her social environment, the judgment reinforces that the alteration or violation of personal identity can affect human dignity and must be treated with special care within the legal framework, the methodology used in this analysis is argumentative, using documentary analysis as a technique and a matrix of legal content analysis based on data and sources of jurisprudence as an instrument, since it seeks to defend the importance of recognizing personal identity as a fundamental right.
