La disolución conyugal ante un notario.

Abstract

Since the dissolution of the conjugal partnership is a procedure that is carried out daily in our social environment, and in view of the fact that at present said procedure can be carried out in a Notary Public, I have thought it appropriate to prepare this legal essay on the subject , to socialize the procedure to be followed for processing before a Notary. The general meaning of this research work carries with it a deep analysis about the conjugal partnership and its dissolution carried out before a notary public in order to speed up its processing compared to when it is carried out or requested through the judicial process. A legal essay will also be prepared on the dissolution of the conjugal partnership held before a notary public, in order to speed up the legal process regarding property rights. Within this essay, we will begin by studying the conjugal partnership within Ecuadorian legislation, that is, its origin, a brief historical review, its conceptualization, characteristics, and the current legal framework will be made; then an analysis of the dissolution of the conjugal partnership in civil law will be made, then analyzing the procedure to be followed for said procedure before a notary. In the same way, in the present investigation, criteria of several of the writers and scholars of Law, both national and foreign, were used, in order to obtain complete information for the development of our investigation.
