Abstract

The research addresses the imprescriptibility of sexual crimes against children and adolescents in Ecuador, highlighting the relevance of this issue in the protection of the rights of children and adolescents. The problem identified is the difficulty faced by victims in reporting these crimes immediately due to fear, shame and manipulation by the aggressors. The objective is to analyze how imprescriptibility influences the obtaining of justice, considering the existing sociocultural and institutional barriers. The methodology applied includes a qualitative approach with deductive and analytical methods, using bibliographic-documentary techniques, observational and interviews. The case examined involves a young man who, years after being abused by his physical education teacher, decides to report the crime. The analysis of results reveals that imprescriptibility allows victims to seek justice at any time, which is crucial due to the lasting effects of trauma. However, significant challenges are identified in the implementation of these regulations, including the need for adequate resources and training for judicial personnel. The conclusions underscore the importance of imprescriptibility to ensure continuous and accessible justice for victims, recognizing the seriousness of these crimes. It is recommended to strengthen the judicial system with more resources and training programs, as well as to promote awareness campaigns to reduce the stigma associated with reporting sexual abuse. In addition, it is suggested to implement psychological and social support measures for victims, ensuring a comprehensive and effective response to these crimes.
