Plan de trabajo y vacío normativo en la Ley Orgánica Electoral, Código de la Democracia.

Abstract

In Ecuador it has been shown that the electoral field has been one of the aspects where an effective regulation has been sought to be implemented that allows to know the work plan and the objectives of the candidates, this is why as a result of the entry into force of the Organic Electoral Law, Code of Democracy, it is established that as part of the requirements for the registration of a candidacy, it is necessary to know what the work plan is, which must contain a structure where the current diagnosis of the country is determined, the objectives and a proposal where it contemplates the possible solutions to mitigate the problem, which although it is an important initiative so that the citizen can vote in an informed manner, this leads to analyzing how real is the compliance of what is contemplated in said document, which leads to analyzing article 97 of the Organic Electoral Law, Code of Democracy within which a regulatory vacuum is evident, in that it contemplates what the work plan should contain, but does not delimit control mechanisms or which entity and authority is responsible for verifying its compliance, which in many cases leads to only They are constituted as campaign promises, moving away from the legal purpose of their creation, being the foundation that shows the need to integrate a legal reform that allows control in the execution and compliance of said document, thus respecting the popular will expressed at the polls.
