| dc.description | La voz humana, como dato biométrico único, es un elemento esencial de la identidad personal. Sin embargo, en la legislación ecuatoriana, aunque se reconoce la protección de la voz en la Constitución y en el Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación – INGENIOS, aún existen vacíos legales que permiten su uso y explotación no autorizada, especialmente con el avance de tecnologías como la inteligencia artificial. Esta tesis analiza la legislación vigente, identificando sus limitaciones y proponiendo reformas que fortalezcan la protección de la voz como dato biométrico y como objeto de derechos de autor. Se propone una reforma legal específica para integrar la voz como dato biométrico en la Ley Orgánica de Protección de Datos Personales y reforzar su protección en el Código de Ingenios, especialmente en el contexto de la interpretación artística y el uso de tecnologías emergentes. | en_US |
| dc.description.abstract | The human voice, as a unique biometric data, is an essential element of personal identity. However, in Ecuadorian legislation, while voice protection is recognized in the Constitution and the Organic Code of the Social Economy of Knowledge, Creativity, and Innovation – INGENIOS, there are still legal gaps that allow its unauthorized use and exploitation, especially with the advancement of technologies such as artificial intelligence. This thesis analyzes the current legislation, identifying its limitations and proposing reforms to strengthen voice protection as biometric data and as an object of copyright. A specific legal reform is proposed to integrate voice as biometric data in the Organic Law on Personal Data Protection and to reinforce its protection in the INGENIOS Code, especially in the context of artistic interpretation and the use of emerging technologies. | en_US |
