| dc.description | Considerando las prácticas inconsistentes de las autoridades registrales y municipales en la transferencia de derechos y acciones hereditarias, este documento examina cómo el Código Civil ecuatoriano establece un marco normativo definido, aunque su implementación en la práctica enfrenta retos considerables. Se discuten las problemáticas relacionadas con las restricciones adicionales que imponen estas autoridades, las cuales no están contempladas en la ley, y cómo estas prácticas impactan negativamente la seguridad jurídica de herederos y compradores, creando incertidumbre y riesgos legales. A partir de este análisis, se sugieren recomendaciones que incluyen la necesidad de estandarizar la aplicación de la normativa y eliminar barreras innecesarias, con el fin de asegurar un proceso sucesorio eficiente, transparente y en línea con el principio de seguridad jurídica, que es fundamental para toda la actividad estatal. | en_US |
| dc.description.abstract | Considering the inconsistent practices of registral and municipal authorities in the transfer of inheritance rights and actions, this document examines how the Ecuadorian Civil Code establishes a defined normative framework, although its practical implementation faces significant challenges. The discussion highlights issues related to additional restrictions imposed by these authorities that are not covered by thelaw, and how these practices negatively impact the legal certainty of heirs and buyers, creating uncertainty and legal risks. Based on this analysis, recommendations are proposed, including the need to standardize the application of regulations and eliminate unnecessary barriers, in order to ensure an efficient, transparent inheritance process aligned with the principle of legal certainty, which is fundamental to all state activities. | en_US |
