Abstract

In case it deals with the origin of the problem on the legal figure of extraordinary birth registration, due to indicators of the increase in the number of judicial processes, in requests for preparatory proceedings on the subject, for which it is now the need to decongest the workload of judges and transfer this type of legal procedure of "voluntary jurisdiction" to the field of notaries in the country. The current Ecuadorian legal norm will be reviewed and taking into consideration a comparative study that reveals which Law is regulated in Costa Rica. Finally, the need to achieve speed is supported, for which it is suggested to reform the Organic Law of Identity Management and Civil Data in its article 31, and transfer matters regarding extraordinary birth registration to the notice of the Notary
