| dc.description | El presente trabajo investigativo versa sobre un análisis a la jubilación patronal en el Ecuador, a su vez, expone la realidad jurídica de esta figura y la existencia de la doble jubilación, en relación con la adscrita al Instituto Ecuatoriano de Seguridad Social. Respecto de aquello, la revisión histórica de la materialización del derecho a la jubilación en el Ecuador trajo consigo un conflicto que se comprende a través de una aparente doble jubilación. En referencia a aquello, la presente prevé la revisión de las normas previstas al respecto tanto en el ordenamiento jurídico ecuatoriano, como en el derecho comparado. Así como el estudio profundo a la realidad laboral existente enel Ecuador, en conjunto con aquella perspectiva con la que se fundó la institución y materialización respecto de la jubilación y los fundamentos que sostienen la vigencia de ambas figuras, jubilación patronal y social. | en_US |
| dc.description.abstract | The present investigative work deals with an analysis of employer retirement in Ecuador, in turn, exposes the legal reality of this figure and the overlap with retirement ofa social nature, mainly attached to the Ecuadorian Institute of Social Security. Regarding that, the historical review of the materialization of the right to retirement in Ecuador brought with it a conflict that is understood through an apparent double retirement. In reference to that, this document provides for the revision of the norms provided in this regard both in the Ecuadorian legal system and in comparative law. As well as the in-depth study of the existing labor reality in Ecuador, together with the perspective with which the institution was founded and materialization regarding retirement and the foundations that support the validity of both figures, employer and social retirement. | en_US |
