Abstract

The inventory benefit is the inheritance for completing the transmission of the rights, assets, liabilities and actions of a deceased person to another person who, by operation of law, assumes those rights. The heirs may act in accordance with the succession established by virtue of the previous will of the deceased person or by virtue of the provisions of the Civil Code corresponding to the Inheritance Code. In case of possible irregularities in the succession or in the way in which probate assets are acquired, the heirs or persons entitled to inherit by reason of death can take the following legal measures if necessary. To avoid family conflicts that may lead to litigation and to maintain legal certainty at the time of succession, an effective analysis of the succession must be carried out at the time of death to ensure that these procedural rules are respected in all cases.
