| dc.description | El presente trabajo académico expone los argumentos, desde mi punto de vista, ciertos, específicos y pertinentes por los cuales se considera que existe una incompatibilidad normativa entre los artículos 4 y 7 de la Ley para estimular y controlar la producción y comercialización del banano, plátano (barraganete) y otras musáceas afines, destinadas a la Exportación, al vulnerar los derechos constitucionales a la seguridad jurídica y a la propiedad privada, así como también los principios constitucionales de proporcionalidad y de no confiscatoriedad, con la finalidad de brindar la posible solución al problema planteado. A lo largo de la tesis se desarrollan también, conceptos y nociones generales que ayudan al lector a una mejor comprensión del tema y se explican aspectos que exponen la relevancia de enmendar tales incompatibilidades de rango constitucional. | en_US |
| dc.description.abstract | The present academic work, exposes the true, specific and pertinent arguments by which it is considered that there is a normative incompatibility between articles 4 and 7 of the following law: “Ley para Estimular y Controlar la Producción y Comercialización del Banano, Plátano (Barraganete) y otras Musáceas Afines, destinadas a la Exportación”, by violating the constitutional rights to legal certainty and private property, as well as the constitutional principles of proportionality and nonconfication, in order to provide possible solutions to the exposed problem. Throughout this thesis, concepts and general notions about the topic are developed, in order to help the reader have a better understanding. Also, it explains topics that exposes the importance of emending this constitutional rank incompatibility. | en_US |
