La aplicación del indulto en el sistema carcelario para disminuir los hacinamientos en centros penitenciarios.

Abstract

Overcrowding in prisions is a reality that causes violent events in the prison system, given the need to have an adequate space to live. The objective of this qualification work is to analyze the application of the pardon in the prison system to reduce overcrowding in prisons for people deprived of liberty of vulnerable groups and those who have an enforceable judgement with good behavior after their crime. A descriptive methodology with a qualitative approach will be used, it will use the scientific method, deduction and analysis of the data obtained through bibliographic review and in-depth interviews applied to lawyers belonging to the forum registered in the council of the judiciary of the province of Sucumbíos of the Necessity of the application of the pardon in the prison system to reduce the overcrowding in penitentiary centers. The data analysis procedure will start from the review of the current legal regulations, elaboration of the questionnaire of in-depth interviews, validation and application for to finally analyze and publish the results, in which it is expected to know the point of view of those who practice the right to pardonand overcrowding.
