| dc.description | Se va a analizar la garantía jurisdiccional del hábeas corpus contemplada en el artículo 89 de la Constitución y artículo 43 y 44 de la Ley de Garantías Jurisdiccionales y Control Constitucional, existen irregularidades, criterios divididos, incertidumbres al momento de la aplicación de la acción y sobre el alcance de dicha garantía. El objetivo es determinar si la ejecución a través de los órganos jurisdiccionales de esta garantía no vulnere el debido proceso, la seguridad jurídica y analizar los puntos claves de las últimas sentencias en donde se visualizan irregularidades, comparar y contrarrestar casos similares, que se encausen en la misma situación analizar qué resolución se dio en cada una y por qué, esclarecer los puntos analizados por qué la corte y analizar que medidas se debería tomar al respecto. | en_US |
| dc.description.abstract | This is an analysis about the jurisdictional guarantee of habeas corpus contemplated in article 89 of the Constitution and article 43 and 44 of the Law of Jurisdictional Guarantees and Constitutional Control, there are some irregularities, divided criteria, uncertainties at the time of application of the action and on the scope of the guarantee. The goal is to determine if the courts are doing and execution that doesn’t violate the due process, legal certainty and analyze the key points of the latest sentences, where irregularities are displayed, compare and counteract similar cases that they are prosecuted in the same situation, analyze what resolution was given in each one and why, clarify the points analyzed by the court and analyze what measures should be taken in this regard. | en_US |
