El procedimiento voluntario : análisis crítico de normas ambiguas en sus procedimiento.

Abstract

The voluntary procedure is an institution that presents distinctive characteristics to the other types of procedures, among them, its non-contentious nature. Certain problems arising from the voluntary procedure can be appreciated, such as the problem of the nature of the procedure, the problematic comes from the opposition and the difficulties ofeach of the procedures. It will be proposed that the figure of opposition in the voluntaryjurisdiction generates problems for the judges of instance, as well as the sui generis problems of the five procedures established in article 334 of the COGEP.
