| dc.description | El Habeas Corpus es una garantía constitucional que busca la protección del derecho a la libertad de la persona que se encuentre privada de ella de manera ilegal, arbitraria e ilegítima. El objeto de esta acción es la protección de los derechos de libertad, derecho a la vida, integridad personal y demás derechos conexos a ellos. Por ende, una de sus modalidades es el Habeas Corpus Correctivo; que busca precautelar y proteger los derechos de las personas privadas de libertad ante los actos de tortura y tratos crueles, inhumanos y degradantes dentro de los centros penitenciarios en el que se encuentren cumpliendo su condena. Ahora bien, ante ciertas limitaciones que sufre el Habeas Corpus Correctivo en nuestra legislación, en la sentencia No. 365-18-JH/21 y acumulada encontramos una respuesta sobreel alcance de esta variante de la referida garantía jurisdiccional, ampliando la tutela del derecho a la integridad personal de las personas privadas de libertad. | en_US |
| dc.description.abstract | The object of this action is the protection of the rights of freedom, right to life, personal integrity, and other rights related to them. Therefore, one of its modalities is the Corrective Habeas Corpus, which seeks to safeguard and protect the rights of persons deprived of liberty against acts of torture and cruel, inhuman, and degrading treatment within the penitentiary centers in which they are serving their sentence. Now, given certain limitations that Corrective Habeas Corpus suffers in our legislation, in Judgment No. 365-18-JH/21 and accumulated we find an answer on the scope of this variant of the aforementioned jurisdictional guarantee, expanding the protection of the right to the personal integrity of persons deprived of liberty. | en_US |
