Abstract

research work will deal with the legal aspects of the right to education in the framework of the health emergency due to the Coronavirus Covid 19; making reference to the obligations of the State regarding the right to education and access to the internet. For the study and analysis of what has been described, the scope of the right to education will be examined in the light of internet access, in the same way, the violation of the right to education due to the digital gap existing in Ecuadorian society will be evaluated. This research is carried out under a qualitative methodological approach, since it will use comparative national and international normative source documentation, as well as jurisprudence and doctrine related to investigative work, which will serve to determine if the lack of internet access affects human rights, and specifically In terms of the right to education, under this logic it seeks to generate legal tools that contribute to solving a problem that has worsened in the context of the global pandemic due to COVID19, which affects the most vulnerable sector of the Ecuadorian population and therefore it merits an emergent action and according to the current needs. This proposal is made to provide a legal solution applied to the need to guarantee the effective enjoyment of rights, tending to achieve an urgent public policy making reference to the obligations of the State in terms of the right to education and internet access in favor of the human dignity.
