El derecho a la resistencia en situaciones de parvedad excesiva en el Ecuador.

Abstract

The general objective of this research was to analyze the right to resistance in situations of excessive poverty in Ecuador. Among its specific objectives, it was proposed to analyze the doctrinal elements about the right to resistance, to determine the legal bases of the right to resistance in Ecuador, to establish in which situations the citizen can exercise the right to resistance. The methodology that was used in this research was of a documentary and bibliographic nature, also making use of it for the purpose of being able to obtain in-depth knowledge about the right to resistance. As a result of this study, it was determined that, if it is appropriate that the citizens who have been forgotten by the State, that is, those people that the State has not taken into consideration for the purposes of protecting their rights, on the contrary, they have been violated Their human, constitutional and legal rights can exercise the right of resistance provided for in Article 98 of the National Constitution. This research proposed strategies for the training of citizens and public officials of Ecuador on the right to resistance provided for in article 98 of the constitution. Finally, I conclude: The resistance has been misinterpreted by many authors who are of the criterion that is contrary to the spirit of the law when it is not, the resistance is intended to comply with the spirit of the law and it operates in those situations in which the State violates the law violating the rights of citizenship.
