Análisis jurídico del proyecto de la Ley Orgánica Reformatoria de la Ley de Defensa Profesional del Artista.

Abstract

The subject of this degree work is the Legal Analysis of the Reform Organic Law Project of the Law for the Professional Defense of the Artist, proposed reposed by the National Federation of Professional Artists of Ecuador (FERNARPE). As its main vision, it is focused on the study of each chapter and articles covered in relation to the compliance that must be promulgated with Ecuadorian artists, that is, follow-up will be given based on the current reality that artists live, which is complex because for reason of the pandemic (COVID-19). This analysis will serve to verify the compliance or not of the guarantee measures and the principle of equality described in the law, in addition, after it, an opinion will be released regarding the development and progress that has taken place after the new reform and the active participation referring to the social, economic and labor in a field of comparison from the beginning to the present. Through a meticulous analysis, a critical and reflective mechanism will be developed in the study of the law implicitly to identify the responsibility of the state and compliance with the constitution of the republic, section five, where the protection of heritage arises from the support of the culture and art, it is here where the concern to preserve one's own social artistic identity must be maintained within a framework of good living.
