| dc.description | Dentro del presente trabajo investigativo, procederemos a realizar un profundo análisis respecto a la figura jurídica del matrimonio como contrato solemne, haremos una revisión de los contratos solemnes, y un análisis respecto a la recién aprobada figura del matrimonio igualitario, pues como se observara a lo largo del desarrollo de la presente tesis y dentro del planteamiento del problema, existe una necesidad de revisar y analizar tanto la figura jurídica del matrimonio como contrato solemne, como el recién aprobado matrimonio igualitario, todo esto desde el marco de las solemnidades y la validez del contrato como tal. La figura jurídica del matrimonio ha sido reconocida desde la creación de nuestro código civil en 1860, siendo una figura importante y progresiva, empezando como un contrato solemne entre hombre y mujer actual e indisoluble hasta ser simplemente un contrato solemne entre dos personas, pero si analizamos el reconocimiento y la progresividad que le ha dado nuestra legislación a la figura jurídica del matrimonio, podemos realzar el aspecto de ser considerado desde siempre como un contrato solemne. Y es en ese aspecto que voy a centrar el desarrollo e investigación de mi tesis, observando al matrimonio como un contrato solemne, puesto que como se explica en el planteamiento del problema, con el establecimiento de una conceptualización del matrimonio por parte de nuestra norma suprema y la recién aprobada figura del matrimonio igualitario puede llegar a existir una eventual falta de solemnidad a la institución jurídica del matrimonio como tal. | en_US |
| dc.description.abstract | Within this investigative work, we will proceed to carry out a deep analysis regarding the legal figure of marriage as a solemn contract, we will make a review of solemn contracts, and an analysis regarding the recently approved figure of equal marriage, as it will be observed from what Throughout the development of this thesis and within the approach to the problem, there is a need to review and analyze both the legal figure of marriage as a solemn contract, as well as the recently approved equal marriage, all from the framework of the solemnities and the validity of the contract as such. The legal figure of marriage has been recognized since the creation of our civil code in 1860, being an important and progressive figure, starting as a solemn contract between a current and indissoluble man and woman until it is simply a solemn contract between two people, but if we analyze the recognition and progressiveness that our legislation has given to the legal figure of marriage, we can enhance the aspect of being considered forever as a solemn contract. And it is on this aspect that I am going to focus the development and research of my thesis, observing marriage as a solemn contract, since as explained in the statement of the problem, with the establishment of a conceptualization of marriage by our supreme norm and the recently approved figure of equal marriage can lead to an eventual lack of solemnity to the legal institution of marriage as such. | en_US |
