| dc.description | El presente trabajo de investigación tiene como objetivo analizar las obligaciones de la sociedad conyugal frente a la implementación del artículo 44 en el nuevo Código de Comercio. Una vez relatado el avance de la normativa en cuanto a la representación de la sociedad conyugal, se procede a definir conceptos de: comerciante, sociedad conyugal, capitulaciones matrimoniales, disolución de la sociedad conyugal para tener un mejor desarrollo del tema, junto a las características de las obligaciones de la sociedad conyugal. Por otro lado, se fija el alcance del artículo 44 del Código de Comercio del cual surgen distintos cambios: 1) Facilita la prueba de la sociedad conyugal a la que estaba obligada sin necesidad de probar que esta se benefició. 2) Recae sobre bienes que fueron objeto de la actividad comercial. 3) La calidad que deben tener como representante legal de la sociedad conyugal. Y de la misma manera limitaciones de la aplicación del mismo. | en_US |
| dc.description.abstract | The purpose of this research work is to analyze obligations of conjugal society against article 44 implementation in the new Commercial Code. Once the progress of the normative regarding representation of conjugal society has been reported, proceed to define: merchant, marital partnership, marriage certificates, and dissolution of conjugal society to have a better development of the theme, with the characteristics of the obligations of conjugal society. On the other hand, the scope of article 44 of the Commercial Code from which different changes arise: 1) It facilitates the proof of the conjugal society to which it was obliged without the need to prove that it benefited. 2) It falls on goods that were the object of commercial activity. 3) The quality they should have as a legal representative of the marital partnership.
