Análisis de la opinión consultiva Nro. 24 de la Corte Interamericana de Derechos Humanos y sus efectos en el ordenamiento jurídico ecuatoriano.

Abstract

The Inter-American Court of Human Rights is an organism of the Human Rights Protection System of the Region, it emanates from the American Convention of Human Rights, which has two faculties, a contentious and an advisory. The purpose of this paper is the Analysis of the Advisory Opinion No. 24 of the Inter-American Court of Human Rights, therefore, it is essential to analyze in the first instance, the Background of the Inter-American Court and its functions, especially the Consultative Function according to the Court itself and the doctrine. Later we will analyze the possible effects of this consultative opinion in our internal laws, within the framework of our Constitution and in the normative hierarchy, we will also briefly analyze the resolution of the Constitutional Court of June 12, 2019, in this regard; to conclude whether the application of Advisory Opinion No. 24 was legally and constitutionally binding by the Constitutional Court
