Análisis de la difusión social de las atribuciones y competencias de los notarios(as) en la ciudad de Guayaquil.

Abstract

This research was done due to the lack of social dissemination of the notaries 'powers and competencies, proposing the following question: How are t he citizens of Guayaquil affected due to the lack of knowledge about the notaries' powers and competencies? The purpose of my research is to analyze the social dissemination of the legal attributions of the notaries and the way to achieve it to my point o f view is through a critical study on the legal aspect, theoretical and empirical bases that allow to point out the advantages and disadvantages. Furthermore, great theoretical contributions are shown in this research, indicating the lack of dissemination of legal attributions and notaries’ fees and also a proposal which is running in Lima - Peru related about legal fairs for citizens where they can obtain accurate information regarding notary's legal attributions. These fairs are named "The notary in your neighborhood." The methodologies used for this research are quantitative and qualitative, category: non - experimental, designs: descriptive, observational and non- comparative. The finite formula was used in the surveys, and a sample size was applied in the i nterviews. On the observation unit, several legal frameworks appropriate to the research structure were taken. Finally, the surveys show that 66.05% of citizens of Guayaquil confuse and ignore the legal attributions of the notaries with the judge legal att ributions. The notaries indicated, in the interviews, that the Judiciary Council should use more communication sources for legal dissemination. In particular, both the community and the notaries agree that spread by the Judicial Council is further promoted through fairs and communication media.
