Resumen : Lawyers see with great concern how the num. 6 of art. 333 of the General Organic Code of Processes (COGEP) discriminates against us by denying us the constitutional right to appeal the sentences that are pronounced within the trials in which the controversies between the lawyer and client for the payment of professional fees are aired, highlighting this legal provision that appeals cannot be lodged against these sentences, not even in fact, which prevents us from reviewing our sentence by an appeal judge in the event that it is unfavorable to our interests. In this sense, the general objective of the present work is to analyze and establish how the num. 6 of art. 333 of the COGEP violates the constitutional principle of appealing the ruling or resolution in all procedures in which it is decided on our rights guaranteed in lit. m) of no. 7 of art. 76 of the Constitution. The methodology used has a qualitative approach, since it plans to study the aforementioned constitutional principle, establishing its scope, its recognition as a principle and guarantee in our Constitution and in international instruments, and how the restriction of this right is unconstitutional and discriminatory within summary trials for collection of professional fees. The results of the case study show that the num. 6 of art. 333 of the COGEP is discriminatory and violates the rights to due process and defense, so it is concluded that the unconstitutionality of this article should be sued.
Descripción : Los abogados vemos con mucha preocupación como el num. 6 del art. 333 del Código Orgánico General de Procesos (COGEP) nos discrimina al negarnos el derecho constitucional de recurrir las sentencias que se pronuncien dentro de los juicios en que se ventilen las controversias entre el abogado y cliente por el pago de honorarios profesionales, remarcando esta disposición legal que contra estas sentencias no podrán interponerse los recursos de apelación ni de hecho, con lo cual se nos impide que un juez de alzada revise nuestra sentencia en el caso de que nos sea desfavorable para nuestros intereses. En ese sentido, el objetivo general del presente trabajo es analizar y establecer cómo el num. 6 del art. 333 del COGEP vulnera el principio constitucional de recurrir el fallo o resolución en todos los procedimientos en los que se decida sobre nuestros derechos garantizado en el lit.m) del num. 7 del art. 76 de la Constitución. La metodología empleada tiene un enfoque cualitativo, pues tiene previsto estudiar el referido principio constitucional estableciendo su alcance, su reconocimiento como principio y garantía en nuestra Constitución y en instrumentos internacionales y cómo resulta inconstitucional y discriminatoria la restricción de este derecho dentro de los juicios sumarios por cobro de honorarios profesionales. Los resultados del estudio del caso demuestran que el num. 6 del art. 333 del COGEP es discriminatorio y viola los derechos al debido proceso y a la defensa, por lo que se concluye que debe demandarse la inconstitucionalidad de este artículo.</description>

Resumen : The dismissal of women from public sector employment due to maternity, despite existing constitutional guarantees of protection, generates controversy regarding the scope of enhanced job security in relation to different forms of employment. This study aims to analyze the constitutional guarantee of enhanced job security in Ecuador, through a review of Constitutional Court Ruling No. 3-19-JP/20 and related cases. This research employs a qualitative approach, applying the legal method, the analytical-synthetic method, and case study methodology, in addition to documentary analysis of regulations, doctrine, and constitutional jurisprudence. The results obtained demonstrate that this constitutional guarantee protects the labor rights of pregnant and breastfeeding women regardless of their employment arrangement, establishing jurisprudential criteria aimed at ensuring their continued employment. Furthermore, it was established that this special protection is linked to rights such as equality and non-discrimination, work, care, and social protection. It is concluded that enhanced job security is a mechanism for protecting fundamental rights that prevents dismissal when rights related to maternity and breastfeeding are at stake.
Descripción : La desvinculación laboral de mujeres por su condición de maternidad en el sector público, a pesar de existir garantías constitucionales de protección, genera controversias en relación al alcance de la estabilidad laboral reforzada frente a distintas formas de contratación. Este trabajo tiene como objetivo analizar la garantía constitucional de estabilidad laboral reforzada en el Ecuador, con el estudio de la Sentencia No. 3-19-JP/20 y acumulados de la Corte Constitucional. El trabajo de investigación tiene un enfoque cualitativo, aplicando el método jurídico, método analítico-sintético y el estudio de caso, además del análisis documental de la normativa, doctrina y jurisprudencia constitucional. Los resultados obtenidos demostraron que esta garantía constitucional protege los derechos laborales de mujeres gestantes y lactantes sin importar su forma de contratación, estableciendo criterios jurisprudenciales orientados a garantizar su permanencia en el trabajo. Además, se pudo establecer que esta protección especial está vinculada con derechos como la igualdad y no discriminación, el trabajo, el cuidado y la protección social. Se concluye que la estabilidad laboral reforzada es un mecanismo de protección de derechos fundamentales que impide la desvinculación laboral, cuando están comprometidos derechos relacionados con la maternidad y lactancia.</description>

Resumen : This article analyzes the compatibility between the evidence for better resolution provided for in Article 168 of the Organic General Code of Processes and the constitutional principle of contradiction of evidence recognized in letter h) of numeral 7 of Article 76 of the Constitution of the Republic of Ecuador. The objective of the study is to determine whether the judicial power to order evidence for better resolution affects the guarantees of due process, particularly the free presentation and contradiction of evidence. The research was conducted under an approach that has a dogmatic-legal character based on the analysis of constitutional and procedural regulations, specialized doctrine, and relevant jurisprudence. The fundamental technique used was the systematic and constitutional interpretation of the normative provision we found. The results show that evidence for better resolution may place tension on the principle of contradiction whenever it implies altering the procedural balance or substituting the evidentiary initiative of the parties, but criteria are also found that allow the harmonization of both institutions within the framework of the constitutional State of rights and justice. It is argued that the compatibility between evidence for better resolution and the principle of contradiction depends on a strictly rights-protective application, which must have constitutional limits and must consider the equality of the parties in a trial and the right of defense.
Descripción : El presente artículo analiza la compatibilidad entre la prueba para mejor resolver prevista en el artículo 168 del Código Orgánico General de Procesos y el principio constitucional de contradicción de la prueba reconocido en el literal h) del numeral 7 del artículo 76 de la Constitución de la República del Ecuador. El objetivo del estudio consiste en determinar si la facultad judicial de ordenar prueba para mejor resolver afecta las garantías del debido proceso, particularmente la libre presentación y contradicción probatoria. La investigación fue realizada en un enfoque que tiene un carácter dogmático-jurídico a partir del análisis de la normativa constitucional y procesal, doctrina especializada y jurisprudencia relevante. Se utilizó como técnica fundamental la interpretación sistemática y constitucional de la disposición normativa que encontramos. Los resultados evidencian que la prueba para mejor resolver puede tensar el principio de contradicción siempre que suponga alterar el equilibrio procesal o sustituir la iniciativa probatoria de las partes, pero también se hallan criterios que permiten armonizar las dos instituciones dentro del marco del Estado constitucional de derechos y de justicia. Se argumenta que la compatibilidad entre la prueba para mejor resolver y el principio de contradicción depende de una aplicación estrictamente garantista, que tenga como límites los que son constitucionales y que atiendan la igualdad de las partes en un juicio y el derecho de defensa.</description>

Resumen : This essay examines the nature and limitations of the protective action in Ecuador, particularly as it relates to administrative acts of the public service. Although the Constitution recognized it in 2008 as a jurisdictional guarantee protecting against direct violations of fundamental rights, its use by various public officials has distorted its general purpose, employing it to challenge ordinary administrative resolutions.&#xD;
This has led to an overload of constitutional justice, creating legal uncertainty and weakening administrative jurisdiction. On the other hand, the legal framework of the Organic Law of Jurisdictional Guarantees, the Organic Administrative Code, and the Constitution stipulates various effective ordinary mechanisms; the protective action is not required in these cases. It is worth noting that the Constitutional Court emphasized that its function should only be used to review the legality of actions in situations of serious and direct violations of rights. This essay distinguishes between void acts and those that are subject to challenge, the latter being an ordinary procedure. At the same time, the relevance of the principles of reasonableness and proportionality in judicial analysis is highlighted, specifically in situations involving dismissals from public service.&#xD;
Finally, it is emphasized that the protective action should be of an extraordinary nature, ensuring constitutional supremacy without replacing oversight of administrative legality. Therefore, this study suggests consolidating jurisprudential criteria to prevent abuses and strengthen the justice system.
Descripción : Este ensayo examina el carácter y las restricciones que tiene la acción de protección en Ecuador, sobre todo aquello con relación a los actos administrativos del servicio público. A pesar de que en el 2008 la Constitución la reconoce como una garantía jurisdiccional protegiendo violaciones directas a derechos esenciales, el uso que han obtenido diversos funcionarios públicos desnaturalizando su propósito general, empleando el cuestionamiento de las resoluciones administrativas comunes. De este modo, ha provocado una sobrecarga en la justicia constitucional, creando inseguridad jurídica; es por esto que ha debilitado a la jurisdicción administrativa. Por otro lado, el marco normativo sobre la Ley Orgánica de Garantías Jurisdiccionales, el Código Orgánico Administrativo y la Constitución estipulan los diversos mecanismos ordinarios eficaces; no se requiere la acción de protección. Cabe resaltar que la Corte Constitucional enfatizó que su función solo debe usarse para revisar su legalidad en situaciones de violaciones graves y directas de derechos. Este ensayo diferencia entre los actos nulos y los que son impugnables, siendo un conducto ordinario. Al mismo tiempo, la relevancia de los principios de la razonabilidad y la proporcionalidad ante el análisis judicial, específicamente aquellas situaciones que involucran destituciones en el servicio público. Finalmente, se enfatiza que la acción de protección debe tener un carácter extraordinario, asegurando la supremacía constitucional sin reemplazar una supervisión en la legalidad administrativa. Es por eso que, al realizar este estudio, se sugiere consolidar, con criterios jurisprudenciales para evitar abusos y robustecimiento en el sistema de justicia.</description>
