Resumen : In Ecuador, the concept of the State's extra-contractual liability arises when a public institution causes harm that an individual is not legally obligated to suffer. This harm may result from an action or omission by the institution. While Ecuadorian law recognizes the duty to compensate for these damages, it does not establish a specific methodology for determining the amount of financial compensation. Therefore, it is necessary to incorporate technical criteria that allow for differentiating between the various types of damages and establishing verifiable parameters for their quantification.
Descripción : En el estado ecuatoriano la figura de la responsabilidad extracontractual del Estado surge cuando una de las instituciones públicas ocasiona un daño que el particular no tiene la obligación jurídica de soportar, esto se puede dar ya sea por una actuación u omisión por parte de la misma institución. Si bien el ordenamiento jurídico ecuatoriano reconoce el deber de reparar dichos daños, el mismo no establece una metodología específica para determinar la cuantía de la reparación económica, lo cual se tiene que plantear la necesidad de incorporar criterios técnicos que permitan diferenciar los distintos tipos de daños y establecer parámetros verificables para su cuantificación.</description>

Resumen : Customs control may reveal, from the same set of facts, elements relevant both to the determination of a tax obligation and to the exercise of the sanctioning power of Ecuador’s National Customs Service (SENAE). The legal issue arises when these two functions are confused and a tax discrepancy detected during customs control is treated as sufficient grounds for establishing an administrative infringement. This study examines the criteria that allow both powers to be distinguished under Ecuadorian tax and customs legislation and through relevant case law concerning tariff classification, sanctioning proceedings, and the principle of favorability. The analysis concludes that the tax assessment power is aimed at establishing or correcting the elements and amount of the tax obligation, whereas the sanctioning power requires the identification of previously defined unlawful conduct, the determination of the responsible party, action by the competent authority, and observance of due process guarantees. Consequently, a tax discrepancy may justify a tax assessment and may serve as supporting evidence for initiating sanctioning proceedings, but it does not, by itself, constitute sufficient proof of an infringement. Finally, the study identifies a tension in the wording of Article 114 of the Regulations to the Customs Facilitation Title and proposes its amendment to provide a clearer distinction between tax assessment consequences and administrative sanctions.
Descripción : El control aduanero puede revelar, a partir de unos mismos hechos, elementos relevantes tanto para determinar una obligación tributaria como para ejercer la potestad sancionadora del Servicio Nacional de Aduana del Ecuador (SENAE). El problema jurídico surge cuando ambas funciones se confunden y una diferencia tributaria advertida durante el control se utiliza como fundamento suficiente para atribuir una infracción. Este trabajo examina los criterios que permiten delimitar ambas facultades a partir de la normativa tributaria y aduanera ecuatoriana y de la jurisprudencia relativa a la clasificación arancelaria, el procedimiento sancionador y el principio de favorabilidad. El análisis permite concluir que la facultad determinadora tiene por objeto establecer o rectificar los elementos y la cuantía de la obligación tributaria, mientras que la potestad sancionadora exige identificar una conducta previamente tipificada, determinar al responsable, actuar por medio de la autoridad competente y respetar las garantías del debido proceso. En consecuencia, una diferencia tributaria puede justificar una determinación y servir como antecedente para iniciar un procedimiento sancionador, pero no constituye, por sí sola, prueba suficiente de una infracción. Finalmente, se identifica una tensión en la redacción del artículo 114 del Reglamento al Título de la Facilitación Aduanera y se propone su reforma para diferenciar con mayor claridad las consecuencias determinativas de las sancionadoras.</description>

Resumen : In the absence of specific parameters for preventing and detecting the recruitment of adolescents by organized crime groups, as well as clear criteria for assessing situations involving threats or coercion when determining their responsibility, a regulatory gap becomes evident within the Ecuadorian legal system. This research develops the legal foundations of functional authorship and analyzes the liability framework applicable to adolescents, taking into consideration national legislation, constitutional jurisprudence, and comparative law. Based on this analysis, a response to this issue is proposed through amendments to the Comprehensive Organic Criminal Code and the Code on Children and Adolescents, as well as public prevention policies in schools and educational institutions, with coordinated support from the Ministry of Economic and Social Inclusion. The proposal seeks to strengthen prevention and ensure the proper individualization of responsibility by considering the particular circumstances of each adolescent, including their level of knowledge, autonomy, and conscious participation within the criminal structure.
Descripción : Al no existir parámetros específicos para la prevención y detección del reclutamiento de adolescentes por parte de grupos de delincuencia organizada, ni criterios claros para valorar situaciones de amenaza o coacción al momento de determinar su responsabilidad, se evidencia un vacío normativo dentro del ordenamiento jurídico ecuatoriano. Esta investigación desarrolla los fundamentos jurídicos de la autoría funcional y analiza el régimen de responsabilidad de los adolescentes, tomando en consideración la normativa nacional, la jurisprudencia constitucional y la legislación comparada. A partir de este análisis, se plantea una respuesta frente a esta problemática mediante propuestas de reforma al Código Orgánico Integral Penal y al Código de la Niñez y Adolescencia, así como políticas públicas de prevención dentro de escuelas y colegios, con el acompañamiento articulado del Ministerio de Inclusión Económica y Social. La propuesta busca fortalecer la prevención y permitir una adecuada individualización de la responsabilidad, considerando las circunstancias particulares de cada adolescente, su nivel de conocimiento, autonomía y participación consciente dentro de la estructura delictiva.</description>

Resumen : Strip it down to the basics and burnout is just the body and mind hitting a wall after being slammed by work stress for way too long. For a long time, people looked at this through a tiny medical lens, basically treating it like some personal failing or a private health glitch that an individual had to fix on their own. That way of thinking is pretty much dead now. We have to look at the bigger picture. Today, the workplace needs a serious legal overhaul because safety isn't just about making sure someone doesn't slip on a wet floor or get hit by a falling crate. Protecting people means addressing the invisible stuff too. If you ignore the psychological side of things, you're missing the point. Mental strain can wreck a person's well-being just as fast as a physical injury, and when people are struggling mentally, productivity inevitably takes a nosedive. Down in Ecuador, this isn't just a suggestion. It's baked into the system. Between the Constitution, the Labor Code, and the specific mandates from the Ecuadorian Social Security Institute, the duty to keep workers safe and healthy is a clear, legal requirement. The problem is that this recognition has not translated into an express treatment of burnout within the legal framework of occupational diseases. This research sets out to determine exactly that: whether the Ecuadorian legal system offers sufficient protection against this phenomenon, or whether a regulatory reform is needed to strengthen it.
Descripción : El síndrome de burnout es, esencialmente, una respuesta al estrés laboral crónico que no se ha gestionado a tiempo. Durante mucho tiempo se vio casi exclusivamente como un tema clínico, pero las condiciones de trabajo actuales nos obligan a analizarlo también desde el ámbito del derecho. No basta con poner cascos o señalizar zonas de peligro si dejamos que el estrés y la carga mental terminen por hundir al trabajador. Al final del día, un empleado agotado psicológicamente es un empleado que no rinde, y eso es un problema real. Si miramos lo que dice la ley en Ecuador, tenemos la Constitución, el Código del Trabajo y las normas del IESS, que en teoría exigen proteger la salud integral de la gente en sus puestos. Pero aquí es donde la cosa se complica. Aunque las leyes actuales tocan el tema del bienestar, lo hacen de forma muy ligera, casi de pasada. El gran vacío está en que no existe un reglamento específico que catalogue el burnout o agotamiento profesional como una enfermedad causada directamente por el trabajo. Es como si tuvieras un mapa que te asegura llegar a tu destino, pero no te dice absolutamente nada sobre qué hacer si te falta el aire a mitad del camino. Este estudio busca entender si el sistema legal de Ecuador realmente protege al trabajador cuando esto sucede, o si lo que urge es una reforma profunda que permita prevenir el problema, detectar los casos a tiempo y, sobre todo, asegurar que se paguen las indemnizaciones que corresponden.</description>
